Terms of Service

Please read my Terms of Service carefully before applying, as payment is agreement to these terms!

General

My office hours where you are guaranteed a response are Monday-Friday from 9 AM to 5 PM CST (Central Standard Time). I do not work weekends unless I make an exception. This is my full time job and I am trying to maintain a healthy work/life balance. Thank you for your understanding.Proper credit of all my models is required; You may not pass the model off as your own creation. You can credit me by saying I'm responsible for the avatar or edits and linking my Twitter, Twitch, Portfolio, or other relevant platform.My models are primarily used for VRChat and VTubing. These purposes require FBX and VRM files, and I cannot guarantee my work will fit other formats and am not responsible for formatting issues.My models work with full body tracking and I can combine your proportions with the reference sheet and get something functional and cohesive to the reference art. If you want full body tracking but you want the proportions exactly as seen on the reference, or you do not provide measurements for me, I cannot guarantee no issues with full body tracking and am not liable for those issues.You may not upload images of your 3D model to AI programs or AI software with the goal of training the program, synthesizing new artwork for personal, promotional, or commercial use, or any other reason. You may upload edited images of your avatar, but you may not use AI to enhance or edit the image of the model itself. Standard Photoshop tools that may be AI driven (content-aware unblur or background editing) is allowed.Breach of anything listed in these terms dissolves your exclusive right to the model commissioned.

Commercial Information

Commercial assets are assets that will be used to cultivate the client's brand or directly make client money through selling or offering the asset for download. Examples of commercial assets include but are not limited to VTubing Models for streaming platforms or videos and custom base or prop you want to sell on Gumroad.Commercial Prices: At Least 150% of Regular Price EstimateContact me for more information and to discuss the scope of your Commerical distribution rights.

Intellectual Property Rights

I will not redistribute your commissioned artwork as it is provided you have paid the commission in full and have not breached the terms outlined here. Failure to pay the agreed upon price gives me the right to redistribute anything created during this commission as I please.You do not own the rights to redistribution. Should you want to distribute the 3D model in anyway (e.g. put it on merchandise, make it publicly available, sell the model itself) you must contact me first.Paying the commercial price only encompasses the scope of commercial distribution the we have agreed on. If you want to expand it, you must contact me first.I maintain the rights to use commissions work for promotional and portfolio purposes.

Cancellations and Refunds

I reserve the right to cancel or reject a commission for any reason. Should I cancel a commission, a full refund will be provided.If I decide to cancel or discontinue work on a commission due to poor treatment or disrespect towards me, I reserve the right to keep the payment I have received for work already done. You will get whatever I have created for you up until then so you may continue work on that model with another artist.Examples of disrespect are (and not limited to) insulting my work, messaging me outside my office hours and demanding work or a response, and rushing a completion date despite having agreed upon a later delivery time. I will ask you nicely to refrain from such treatment toward me as to move forward with the modeling process, but I reserve the right to cancel if you cannot afford me the same respect I am affording you.Should you choose to cancel a commission after 50% of the modeling process has been completed, I reserve the right to keep the first installment that was paid.I ask for feedback of the model every time I give progress pictures to ensure your satisfaction. Since it is your responsibility to give me feedback for the appropriate changes, you are not entitled to a refund once receiving the completed model based on your dissatisfaction.

Revisions

You are entitled to revisions or fixes of any error made on my part.If a major part of the model needs to be revised or redone, a fee that accurately represents time, skill and resources used will be charged.Note that after 2 months of working on the project, i reserve the right to clear out old files, so make sure you are downloading the packages I send you for safe keeping.

Payment Information

I take payment primarily through Paypal Invoices, but I can also take payment through Stripe, Venmo, and Cashapp.Payment plans are flexible. I normally take 50/50 payment, but I also take payments in up to FIVE installments over the course of a few weeks to two months, with final assets delivered upon payment completion.I reserve your slot upon our agreement and I take the initial payment when I can begin work on your commission.
